- High Speed 2 is looking for Senior Third-Party Agreement Manager who could come from Commercial Manager / Procurement Specialist / Quantity Surveying / Contract Management even commercial Project Manager who has some experience of negotiating and drafting bespoke Third-Party Contractual Agreements with third parties such as: local authority, utilities (stats authorities), Network Rail, Highways Agency, landowners etc. Open to people from client, PQS, contractor or developer background but most of negotiated and developed nonstandard Third-Party contractual agreements.
This is an interesting very varied vitally important role without which HS2 simply would not happen working right across the HS2 programme, which, requires skills in commercial management, contracts, legals, negotiation and complex stakeholder management.
Job Purpose:
The Senior Third Party Agreement Manager will lead the negotiation, development and embedding of contractual arrangements with a variety of selected third parties e.g. local authorities, land owners, highways authorities, rail companies. The agreements will be for a variety of purposes including diversions, connections, asset protection, interface agreements and construction agreements all of which are vital to facilitate the construction and operation of the HS2 network.
Reporting to the Head of Third-Party Agreements working in a Third-Party Agreement Team of 20 managing a team of 4 – 6 Third Party Managers and Assistant, part of the Procurement & Commercial Directorate. The Commercial Third-Party Agreements team supports the creation and development of third party relationships through the negotiation, development and implementation of highly collaborative and value for money agreements.
There are 2 Senior Third Party Agreement Managers
- Utilities: - One will mange a portfolio of utilities and thus must have experience in this space and understand the specific requirements within this sector such as – connections, diversions, Protective provision agreements
- Rail Clients – Principally Network Rail but also included TFL and any other rail third party

Work Situation - Hybrid
The office location is Birmingham Snowhill OR London, Euston they operate a flexible hybrid working model working 2 days a week from the office. Overall this is a very flexible modern employer who cares about delivery not where you deliver from, however, if you wish to be based front the office more you can.
Birmingham £70 – 81,000 + Pen(6/12) + 25 hols
London £80 – 90,000 + Pen(6/12) + 25 hols
Duties & Responsibilities
- Responsible for a portfolio of complex Commercial Agreements, ensuring that these are aligned with the Commercial Strategy and the overall HS2 objectives, including the delivery of wider benefits.
- Supporting the achievement of assurance and governance requirements of all commercial agreement deliverables as defined within the HS2 Construction Procurement Handbook. This includes leading development of agreement strategies/plans including the negotiation plan, developing agreement principles and providing instruction to legal for drafting.
- Present to boards and committees, as required, in order to respond to secure ‘buy-in’ and respond to challenge and scrutiny.
- Engage with other Directorates to identify requirements for third party agreements and to devise programme for delivery and implementation.
- Embed awarded agreements within relevant business teams, ensuring contract management plans are in place.
- Provide subject matter expertise and undertake assurance across a portfolio of awarded agreements throughout the agreement life cycle.
- Manage interfaces with construction (and other) procurements and with directorate commercial team, to influence delivery strategies and to ensure requirements of Commercial Agreements are appropriately shared with contractors.
- Lead development and assess commercial models for charging by third party and/or pricing of HS2 services effectively managing risk, complying with Managing Public Money guidelines and driving best value.
- Support with timely and accurate reporting of Commercial Agreements activity

Required Criteria
Key experience required is negotiating, developing and producing Bespoke Third Party contractual agreements. This could come from a range of roles and backgrounds - Commercial Manager / Procurement Specialist / Quantity Surveying / Contract Management even commercial Project Manager who has some experience of negotiating and drafting bespoke Third-Party contractual agreements with third parties such as: local authority, utilities (stats authorities), Network Rail, Highways Agency, landowners etc. Open to people from client, PQS, contractor or developer background but most of negotiated and developed nonstandard Third-Party contractual agreements.
Looking for someone with strong experience within utilities (gas, water, power, telcom) and another with Rail experience (Network Rail).

Experience
- Experience of negotiating, developing and producing Bespoke Third Party contractual agreements
- Experience delivering performance focused collaborative agreements within a commercial environment.
- Procurement and/or commercial management skills of high value, complex heavy civils / construction or similar works/services
- Experience in the commercial aspect of procurement to ensure that value for money is secured and demonstrated
- Experience of large scale infrastructure projects, rail construction and/or utility projects
- Sponsor / Stakeholder relationship and management experience
