1. JOB PURPOSE
1.1 To provide contract management and procurement project support for Phase Two
2. REPORTING RELATIONSHIPS
2.1 Head of Contract Management, Phase Two.
3. ROLE OF DIRECTORATE/DEPARTMENT
3.1 The role is in the Development Directorate which oversees the development of the railway design.
3.2 The contracts management team leads the management and administration of all contracts, ensuring value for money is delivered, contract deliverables are provided on time and to the required level of quality and that management of costs and activities is accurately recorded.
4. ACCOUNTABILITIES
4.1 Ensure procurement activities are undertaken in compliance with relevant legislation whilst driving a process that will become a benchmark for future projects around the world.
4.2 Innovation, value for money and legacy are key strategic themes within the project delivery strategy that the Senior Contracts and Procurement Project Manager will support the implementation and embedding of process and contracts that will form the foundation of the successful delivery of the project.
4.3 Manage procurements from identification of requirements through to mobilisation and steady state operation of contracts.
4.4 Actively promote and embed HS2 values.
4.5 Present and interface with suppliers, boards and committees, internally and externally up to executive level and represent the Project in a variety of different forums and where applicable interface with other departments and external bodies, such as utility companies and Network Rail.
4.6 Present to boards and committees, as required, in order to respond to challenge and scrutiny and assist with sourcing approvals of the on‐going procurement actions.
4.7 Interact closely with the Contract Managersto ensure that procurement projects are handled over in the most effective way to ensure seamless transition of performance and demonstration of HS2 themes embedded into contract performance management plan.
4.8 Develop robust procurement strategies and the development of procurement tools and templates to ensure effective outcomes on all projects.
4.9 Manage the assistant project manager assigned to them ensuring their output is quality‐ assured at source (and prior to being offered for approval).
4.10 Ensure all contracts are contractually and commercially managed as required, including responsibility for ensuring all contractual timescales are adhered to.
4.11 Manage and monitor the contract deliverables received from the consultant and ensure they are communicated to the appropriate responsible and accountable owners to ensure HS2 meets the contractual timescales.
4.12 Manage and monitor the contract deliverables to be provided by HS2 to the consultant and ensure all such deliverables and associated communications to the consultant are completed in a timely manner to ensure HS2 Ltd meets its contractual obligations. Lead and manage the day to day commercial relationship with the PSCs including ensuring a collaborative and integrative approach is being taken with all PSCs and across all disciplines.
4.13 Promote an environment of collaboration- · Support the Phase Two project delivery team and other HS2 directorates in the administration of Employer's Representative duties.
- · Support the Senior Contracts Manager in providing information for Commercial Reports.
- · Understand, review and implement HS2 contractual, commercial & financial system requirements.
- · Understand and review the project funding and delivery budget.
- · Take the lead for effective cost control, maintaining close liaison with functional managers for Project Controls, Change Management, Planning, Risk Management, Finance and Procurement.
- · Liaise with the project controls team with respect to the consultants progress, spend and performance reporting.
- · Undertake regular commercial reviews of all consultant costs, including their subconsultant costs, and implement appropriate mitigation measures as required and generally proactively manage contract expenditure against project budget.
- · Ensure that periodic reporting and cost data are accurately managed for the Actual Cost of Work Performed (ACWP) and the Estimate to Complete (ETC) and any variances against budget are explained in commercial reports.
- · Lead and proactively manage the Early Warning process.
- · Proactively support mitigation measure initiatives captured on the contract risk registers.
- · Lead and proactively manage change instructions, including managing the progress of change requests through the HS2 governance structure and in association with other HS2 functions.
- · Take the lead in the assessment of quotations and assessments by others in connection with Compensation Events.
- · Provide an early warning system for commercial and financial implications of potential claims.
- · Oversee claims rejection, negotiation or acceptance procedures.
- · Ensure all appropriate IDT team members are fully informed of the status of claims.
- · Review risks, change and claims against budget and contingency spend.
- · Agree justification and release of contingency monies.
- · Determine the amount that should be paid to the consultant in each period, including carrying out audits and taking disallowed costs into consideration.
- · Ensure the consultant is timeously paid the appropriate amounts in accordance with the contract; including expenses and any incentive payments.
- · Make sure all works delivered represent value for money and ensure that fair and effective commercial management processes are implemented and maintained during the life of the contract.
- · At all times manage compliance with HS2 Ltd Commercial Governance rules.
- · Ensure collaborative working to ensure clientside functions are operating effectively and not presenting barriers to the PSC’s ability to deliver.
5. REQUIRED CRITERIA
5.1 SKILLS:

5.2 KNOWLEDGE:
EU procurement directives, with awareness of government initiatives and policies with the ability to manage it;
ii.working with or for publicly funded bodies including central government departments;
iii. NEC3 contracts;
iv. BS8903 Sustainable Procurement;
v.BS11000 Collaborative Business Relationships SharePoint, Enterprise Bridge or similar document management software; and vi. strong knowledge of different forms of contract and risk allocation.
5.3 TYPE OF EXPERIENCE:
i.record of procuring large of circa £500m value construction or similar services through OJEU and frameworks;
ii.thorough knowledge of applicable EU and UK procurement legislation including contracts using the NEC suite;
iii.record of procuring via collaborative, incentivised contracts with different pricing and risk options;
iv.setting metrics for procurement selection purposes and contract performance measurements;
v. able to work closely with internal and external stakeholders;
vi. cultivating strong relationships with existing and potential suppliers;
vii. confident when interfacing with senior management and executives; and
viii. member of CIPS or equivalent.

6. DECISION MAKING
6.1 The post holder can decide the following:
i. no financial delegated authority is designated to this job;
ii. make operational decisions that determine the positions and principles of the procurement life‐cycle. Clearly articulated rationale to support such decisions, with deliberations being recorded for future assessment and/or audit purposes;
iii. recruiting and managing team members including performance appraisals; and
iv.identifying and capturing risks that need to be reported to the Head of Contract Manager Phase Two.
v. The following decisions are referred for approval:
vi. all decisions regarding budget or committing HS2 to any contractual obligation.
